Terms of Service

1. Service Description

ambio is an AI-powered platform that generates background music for restaurants. The service uses artificial intelligence to create music tailored to your restaurant's atmosphere and cuisine type.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must be at least 18 years old to use this service.

3. Subscription Plans

ambio offers the following plans:

• Free: Limited access with 1 restaurant and 1 sample song
• Starter: Full playlist generation for 1 restaurant, 2 playlists per month
• Pro: Up to 3 restaurants, 6 playlists per month, Big Picture mode, AI-origin certificates, and time-based scheduling
• Business: Unlimited restaurants, 12 playlists per month, all Pro features plus priority support

Paid subscriptions (Starter, Pro, Business) are billed through Stripe. You may cancel at any time; access continues until the end of the current billing period.

4. AI-Generated Content

All music on ambio is generated by artificial intelligence (powered by Suno). By using the service, you acknowledge the following:

• You receive a license to use generated music within your restaurant, not ownership of the underlying compositions.
• AI-generated music is created without human composers or performers, and is not registered with any collecting society (GEMA, BUMA/STEMRA, SABAM, etc.). The legal status of AI-generated works is evolving and may vary by jurisdiction.
• GEMA certificates provided by ambio serve as documentation of AI origin, not as legal guarantees regarding GEMA obligations. It is your responsibility to verify compliance with applicable collecting society requirements in your jurisdiction.

5. Acceptable Use

You agree not to misuse the service, including but not limited to: redistributing generated music outside your licensed venue, attempting to reverse-engineer the AI models, using the service for unlawful purposes, or interfering with the platform's operation.

6. Intellectual Property

The ambio platform, including its design, code, and branding, is the intellectual property of ambio. Generated music is licensed to you under the terms of your subscription plan. You retain ownership of your restaurant data, preferences, and configurations.

7. Limitation of Liability

ambio is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you have paid for the service in the 12 months preceding the claim. This does not affect mandatory consumer protection rights under applicable law.

8. Termination

You may terminate your account at any time. Upon termination, your data will be deleted within 30 days. We reserve the right to suspend or terminate accounts that violate these terms, with notice where reasonably possible.

9. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. The courts of Hamburg, Germany have exclusive jurisdiction over any disputes arising from these terms, unless mandatory consumer protection laws require otherwise.

10. Changes to Terms

We may update these terms from time to time. We will notify registered users at least 30 days before material changes take effect. Continued use of the service after the notice period constitutes acceptance of the updated terms.
